Subject: Monitoring of work on the Grand Clovis playground

On 8 July 2025, we contacted you following concerns raised by many parents regarding the start of work on the Grand Clovis playground.

We asked you to urgently take all necessary measures to protect and ensure the health and safety of the children and staff at the nursery, in particular by receiving the risk prevention plan before the start of the work ( link ).

Further to our correspondence of 23 July ( link ) regarding health, safety and prevention, you confirmed that the Health and Safety plan (Plan de Sécurité et Santé, hereafter PSS) had been prepared in accordance with the applicable Belgian and European legislation (Arrêté Royal du 25.01.2001, Loi du Bien-être du 04/08/1996, European Directive 92/57 CEE). This document includes an analysis to identify and control risks associated with the works, as well as to limit nuisances… Also as explained during the meeting, and stemming from the preparation of the PSS, the works will take place in a strictly defined area isolated from the rest of the nursery, thereby ensuring protection from nuisances for both children and staff. Also, interventions will occur in an open space outdoors thus ensuring that products used will not affect children nor staff. Activities likely to generate noise or dust are expected to take place during a limited number of days; they will be brief and controlled, and specific measures will be applied to minimize their impact as much as possible, thus preserving the overall well-being of the occupants.

OIB remains fully committed to ensuring a safe and healthy environment for all — children, staff, and contractors alike — throughout the renovation period.

During the information meeting with the parents’ association on October 1, your services guaranteed that the work would not pose any danger to the structure or its occupants, that they had put in place all the necessary measures on the construction site to limit vibrations, and that noisy work would be stopped during nap time, with the well-being of the children and staff being the top priority.

However, on 3 October, several parents reported that their children were exposed to construction noise during nap time. On 6 October, your services responded to a parent, confirming the reports, and stated that they would remind the contractor of its contractual obligations.

On 23 October, the demolition work in the courtyard caused the building to shake and created noise pollution in the part of the building exposed to the work while children and staff were on the premises. Furthermore, there were children playing on the terraces, that overlook the work site.

As outlined in our previous correspondence, we requested that you assess and mitigate the risks associated with noise and other unpredictable factors.

We regret to inform you that the necessary safeguards to protect the well-being of the children and staff exposed to this work have not yet been put in place.

This situation is not acceptable.

In view of the growing threat to the well-being and health of the children and staff, we ask you to fulfil your commitment without delay by finding a solution, including the possibility of suspending the work during the day or providing temporary accommodation for the children while the work is being carried out.

In the meantime, we ask you to confirm that all necessary measures have been taken in order to guarantee that no accidents, of any type, take place.
